Best Practice Guidance: Ownership of Agency Ideas, Plans and Work Developed During the New Business Process

On January 26, 2007, the AAAA Board of Directors adopted a new AAAA position paper. In the position paper The American Association of Advertising Agencies recommends that agencies preserve ownership of new business-search ideas, plans and work product.

The position paper reviews background and considerations associated with agency new business searches. The best practice guidance recommends an early dialog with potential clients on ownership of agency developed ideas, plans and work and the guidance provides illustrative language that can be incorporated in your agency's new business agreements.

We urge that all agency management,who are engaged in the new business process, carefully review the best practice guidance that is contained in this position paper and consider adopting the AAAA recommendation as part of their agency's standard business development practice
